Resham Chaudhary, who was elected chairman during the party's first convention in Tikapur, filed the case after the Election Commission did not grant him recognition.

The EC’s decision stated, “Since it has been observed that an unqualified person was considered as a qualified person and delegated authority to hold a general convention in violation of Section 51 of the Political Party Act, 2073 BS, thereby conducting or facilitating the general convention, the central committee of the Nagarik Unmukti Party, including its chairwoman Ranjita Shrestha, is warned not to engage in any activities contrary to the party's constitution and applicable laws from now onwards.”

After the Election Commission endorsed Ranjita Shrestha as the chairperson of the party, Resham Chaudhary filed a petition on January 12, making the Election Commission and Ranjita Shrestha as the defendants and seeking a writ of certiorari  against them.
